Advertising unlawful gambling is a criminal offence under section 330 of the Act.
This means, these sites should not be being advertised in Great Britain (GB) at all and consumers in GB should be unable to deposit or gamble on the sites in question.
An aggravating factor of your website is that it is directly targeting self-excluded and vulnerable gamblers who may have self-excluded from all legitimate gambling sites licensed by us by self-excluding with Gamstop. Indeed your site specifically mentions that the sites are not on Gamstop and even tells people “How to Get around Gamstop”.
In addition, your website has various areas can click on that take you to other pages - including one relating to Casinos not on Gamstop (https ://montycasinos. com/non-gamstop/
The Gambling Commission (the Commission) regulates gambling in Great Britain (GB) and has the power to prosecute offences under the Gambling Act 2005 (the Act).
You should therefore take immediate steps to stop the advertising of unlawful gambling sites or ensure that your site is blocked to consumers in GB whether they try and access it using a laptop, a mobile phone or a tablet etc.
Section 33 of the Act (as amended by the Gambling (Licensing and Advertising) Act 2014 applies to the provision of facilities for remote gambling if at least one piece of remote gambling equipment used in the provision of the facilities is situated in Great Britain, or if no such equipment is situated in Great Britain but the facilities are used there. The provision of facilities for gambling to persons in the UK through some of the websites that appear on your website is, or is likely to be, unlawful because these services are not licensed by the Commission.
As stated above, advertising unlawful gambling is a criminal offence under section 330 of the Act.
‘Advertising’ is widely defined and includes doing anything to encourage others to take advantage of facilities for gambling or informing others about facilities for gambling with a view to increasing the use of those facilities (section 327 of the Act).
Failure to take immediate action to prevent unlicensed gambling activities being advertised may result in the Commission bringing criminal proceedings against you. The Commission may also take steps to ensure the removal of advertising which promotes unlicensed gambling to customers in Great Britain, which may include contacting your website host to have the website removed.
You can check whether an operator is licensed by the Commission on our website, but you must cease advertising any unlawful facilities for gambling until such time as they are licensed.
