L’Associazione per la Difesa dei Consumatori e degli Utenti (ADICU APS) ha depositato in data odierna un formale esposto/segnalazione presso l’Autorità Garante della Concorrenza e del Mercato (AGCM) contro la società PicRights Italy S.r.l., operante nel settore della gestione e rivendicazione dei diritti d’autore su immagini fotografiche diffuse online.
L’iniziativa si è resa necessaria a seguito di numerose segnalazioni da parte di cittadini, associazioni e piccoli enti non profit destinatari di comunicazioni da parte di PicRights contenenti richieste di pagamento standardizzate per presunte violazioni di copyright, anche in casi di utilizzo non commerciale, occasionale o già rimosso dei contenuti.
ADICU ha evidenziato all’Autorità i seguenti profili di criticità:
Assenza di prova certa della titolarità dei diritti o del mandato ad agire in nome e per conto degli effettivi titolari, in violazione dell’art. 7 della Legge n. 633/1941 sul diritto d’autore;
Condotte potenzialmente aggressive, ai sensi degli artt. 24 e 25 del Codice del Consumo, per l’utilizzo di toni minacciosi, prospettazione di azioni legali immediate e pressioni indebite verso il consumatore medio;
Mancanza di trasparenza informativa nei siti web collegati, che omettono indicazioni chiare sull’identità del titolare dei diritti, sulla determinazione del danno richiesto e sulle modalità di contestazione delle pretese.
L’esposto è stato corredato da riferimenti giurisprudenziali aggiornati (Trib. Milano, n. 5635/2024; Trib. Roma, n. 15327/2023) e da precedenti provvedimenti AGCM, quali i casi Estesa Limited (PS10629) e Registro Italiano in Internet (PS9354), nei quali l’Autorità ha già sanzionato pratiche simili per violazione dei diritti dei consumatori.
“La tutela del diritto d’autore è un principio fondamentale. Tuttavia, non può tradursi in una campagna automatizzata di richieste economiche prive di fondamento, rivolte anche a soggetti deboli, privi di assistenza legale o operanti in buona fede” – dichiara ADICU APS.
L’Associazione si riserva di procedere anche presso il Garante per la Protezione dei Dati Personali e, in caso di persistente comportamento scorretto, di attivare strumenti collettivi di tutela e class action.

fatevi mandare i mandati e/o procure notarili che li autorizzano ad agire in nome e per conto di altri soggetti. Poi richiedete la dimostrazione della effettiva proprietà dell'immagine. Poi, alla terza email andate dai CC e procedete con una denuncia per stalking verso il legale rapp. visto l'insistenza delle email. Se pensano di aver ragione che facciano l'azione legale ed evitino plurime email prive di effetto legale.

Nothing was defamatory in my first review. You are modern day mafia scamming small businesses into trying to pay you.

Just ignore their emails and threats. They are scammers and the scum of the earth. Never respond. That will only encourage them. They have been sending me threats for about 18 months so far. I've ignored them all.

If you EVER receive an email from this website/company. Do your self a massive favour and simply delete the email and forget about it.

They are SCAMMERS. Nothing more, nothing less.

So far across our businesses we have received over 150 emails with a total DEMAND of in excess of £50'000 .

We have NEVER paid a penny and we will NEVER pay a penny.

I've received countless emails and real life mail from this company who reports that they represent the copyright owner for images that I've gotten through subscriptions.

They should not be allowed to legally harass people for money without any proof that they are the actual copyright holders.

Disgusting and will be reporting them to the UK government.

J’étais à deux doigts de payer juste pour avoir la paix, mais ma pépinière m'a conseillé de parler à un avocat avant (Halt AVocats) et il se trouve que ces courriers sont souvent des intimidations mal ficelées. Bref, ne payez pas sans avoir vérifié, vraiment. C’est flippant au début, mais ils ne sont pas toujours dans leur droit !!

Copyright Trolling company - nice way for them to make money terrorizing people making fair use of copyright material which the internet is literally made of. Don't pay them! And search for the article from the Iowa Law Review entitled "Defense Against the Dark Arts of Copyright Trolling" and "Copyright Trolls and Presumptively Fair Uses" in the University of Colorado Law Review.

No, I don’t work for them - I’ve just come out the back end of a claim myself, and I’m offering a helpful perspective so others don’t go into it blind.

Going After Small creators with high few. Hope the people behind this scam business model (making small creators fear) will have bad karma. Shame on you! License costs around 10% of what is claimed by the company. May the universe pay back what you do to people which are only trying to create content - everyone makes faults and that’s part of being human. But being attacked by these amounts of money (800$) as also threatening to escalate with attorneys is really really bad tactic. But as I said: Karma will fix that!

Ho ricevuto una mail da questa società ed ho verificato che un nostro ex collaboratore aveva caricato sul nostro sito un immagine coperta da Copyright. Ho quindi effettuato delle ricerche sulla società in questione trovando decine di recensioni negative sul loro modus operandi. A questo punto però ho deciso di ragionare, di verificare e sopratutto di contattare AP ( Associated Press) chiedendo di verificare sia il contenuto della lettera ricevuta sia di confermare la loro partnership con PicRight e udite udite...lo hanno fatto. Rispondendomi cortesemente, spiegando cosa sia il diritto d'autore ( lo sapevo comunque) e sottolinenando che benché non avessi tratto profitto avevo comunque violato un alegge precisa. La sanzione che devo pagare è minima rispetto anche solo a un tentativo di conciliazione che prevederebbe di affidare l'incarico a un legale. Mi chiedo questa mania di voler essere sempre dalla parte del giusto ( avendo invece torto) di calunniare, di definire queste persone ladre, truffatori, senza approfondire cosa li abbia spinti a contattarvi, da dove ha origine. probabilmente dalla stessa ignoranza che vi ha spinto ad utilizzare immagini protette. Io mi associo visto che ho commesso lo stesso sbaglio. La differenza è che non sono sconfinato nell'ignoranza becera, ma ho cercato di capire rendendomi conto di avere sbagliato. In buona fede, certo, ma ho pur sempre sbagliato. Truspilot è una pagliacciata di proporzioni assurde visto che permette a bipedi con capacità trasformista che li rende quadrupedi di scrivere ogni amenità. Chi sbaglia paga. Io ho sbagliato. Pago e in futuro starò più attento. è così difficile da imparare una lezione banale?

Pic-rights claimed our company infringed Reuters copyright on one pic in a blog and demanded $700 if we couldn't prove we purchased rights to the pic. The blog is 14 years old, put up by an employee who left a decade ago. The copyright act is of 1968. The fair use act of 1976 overrides it. We need to ask, can Reuters prove the pic was copyrighted before 2011 and did anyone else have the pic before Reuters. The pic IPTC embeded data is blank. Does Reuters blank it when a license is issued ? if so, after 14 years how can we prove license when OUR records would have been shredded after 6 years [ as per tax allowances ]. If Reuters do NOT blank the IPTC because it should / would have the copyright owner in the hidden data - then the pic was obtained from a free to use site or a site not authorised to allow download - but we have no way to verify any of this. The blank IPTC form data hidden in the pic, thus resolves us from copyright. breach. A debt collector is under law, not the owner of the alleged debt as per Australian law. If money is owed for copyright infringement, then Reuters must lay the claim. UPDATE as of 24/04/2025. The business employs a contract copyright solicitor and the crux of the matter is 1. under the fair use act we are only obliged to remove the pic 2. no correspondence will be entered into by anyone with any alleged claim and that's the end of the matter.

Multiple demand letters for over $10,000 relating to specific genre of images on a political news website which covered anti-government demonstrations from abroad. Reported to National Security Services for targeting of dissidents as the demand letters have also resulted in the removal of articles critical of the particular foreign government.

Cette société fictive n'est qu'une arnaque bien montée pour gagner du pognon sans rien faire ! ne pas plonger dans ce système d'arnaque. le bouchon est même poussé loin puisqu'un pseudo avocat prend le relai au bout de quelques temps ! je dois reconnaitre que l'arnaque est bien monté et peut rapporter malhonnêtement de l'argent. Comme on dit ! tout est bon pour gagner du pognon ! Ps. pour une boite qui défend les droits d'image, il serait bien d'avoir un logo réel et pas un simple jpeg collé sur une feuille !!!!!

Pic Rights is nothing but a scam!! These clowns actually tried to shake me down for my own image 🤣🤣🤣

Picrights est tout simplement une société qui escroque les gens. Malgré le retrait le leur soit-disante photo, ils continuent leur poursuites jusqu'à vous envoyer des courriers à domicile pour vous soutirer 430€. Comme une amande du gouvernement, ils utilisent des textes sans fondement.

To be fair, I understand a control for property rights, and that entities are assisting copyright holders in the internet age. And moving forward into unknown AI, etc. I honestly thought we had all our ducks in a row with my developers by purchasing photos thru legitimate channels. But one photo somehow was part of the stock, but not covered. To tell you the truth, I would have not written this review.. but then they continued their spree on the subject matter. I was going to pay the initial penalty they asked for; along with asking to be further being educated in the matter. In the beginning, I viewed this experience as a learning lesson. But soon realized they won’t educate, they are just enforcers, intimidators.
Picrights have set themselves up as profiteers in this niche. Not educators, just straight out bandit extortionist tactics. No transparency whatsoever, set a dollar figure from who knows where, and you are expected to pay or they will run to their associated law to tattle tale firm like little girls. (No one likes a tattle tale). Protection racket. What really infuriated me, is I am asking questions and the guy from Picrights, says out of nowhere, after months of receiving letters from them with the same penalty amount.. “oh, actually your penalty is too low as it’s a commercial site we now see” They more than doubled the penalty dollar amount. Typically, an amicable organization would be transparent with their pricing. They run some type of dart board method for all I know. Especially when they are forcing this matter on you. How they come up with their numbers again is never shown, discussed etc. Quasi racketeering.
I have no idea what goes on in Canada regarding entities such as this; who are not transparent to the public on how they come up with their penalty figures from the sky, and transcend to the public. Ridiculous. Total free for all.
Only organized gangs act like this.

Slimy scum set up a bare-bones website with MY address on it as "contact" information, pasted a copyright picture on the webpage, then sent me a letter demanding $1125 from me for using "their" picture. This is defamation, extortion and racketeering.

These cretins need to be in prison.
